Press Statement: Increasing business challenges – Delegations of German Industry & Commerce in China concerned about growing influence of Chinese Communist Party on foreign business operations

We have received reports about attempts of the Communist Party of China trying to strengthen their influence in wholly foreign owned German companies in China. However, current legal and business practices create neither an obligation nor legal basis for companies to proactively promote the development of the party within the respective companies.
According to Article 19 of the Company Law of the People's Republic of China, the establishment of party cells of the Communist Party of China in a company is permissible as long as at least three party members decide to form a party cell. This law applies to Chinese state-owned enterprises and Chinese-foreign invested Joint Ventures as well as Wholly Owned Foreign Enterprises. Based on present business practice, this stipulation hitherto prompted companies to offer meeting facilities to carry out party activities outside of working hours or to authorize extraordinary leave for employees to participate in party activities.
The Delegations of the German Industry & Commerce in China are concerned about recent reports concerning proactive calls on foreign invested companies to promote the development of the Communist Party of China within companies. We do not believe that foreign invested companies generally should be required to promote the development of any political party within company structures. This is an individual decision by corporate management and should not be guided at the behest of third parties. We have observed that business decisions without outside interference are a strong basis for innovation and growth. Should these attempts to influence foreign invested companies continue, it cannot be ruled out that German companies might retreat from the Chinese market or reconsider investment strategies.
For many decades, the over 5000 German companies in China have been active as good “corporate citizens” and directly contributed to the growth of the Chinese economy through creating more than 1.1 million jobs. They are committed to corporate social responsibility and underscore their commitment through a variety of projects in the areas of health, education and environmental protection. German companies enjoy a reputation as reliable and compliant business partners.
